A product could become dangerous at different stages of the process before it reaches the consumer. The point at which the product became dangerous or defective will determine who can be responsible for the harm it causes.

Flaws in the Design

When the problem has a design flaw, the company responsible for the research, development, and design of the item can be held accountable. For example, if designers didn’t account for the melting temperature of a plastic part on a heating pad, then the design itself is flawed.

Flaws in the Manufacturing Process

If the manufacturer used substandard materials that later failed when the product was in use, the maker can be responsible. For example, if the heating pad was well-designed but the manufacturer used a thinner, cheaper plastic than is called for, then they are responsible for the defect.

There Is a Filing Deadline for Product Liability Lawsuits
