The Jones Act

The Jones Act enables injured offshore workers to receive payment from their employer for any damages. Under the act, the employer must be proven negligent, the vessel unseaworthy, or a combination thereof. 

Suppose the plaintiff can prove their injuries directly resulted from the employer breaching their duty of care for their employee. In that case, their employer may compensate the plaintiff for past and present damages. Damages include medical bills, pain and suffering, and lost pay due to any injuries or recovery process. 

Longshore and Harbor Workers’ Compensation Act

Alternatively, injured offshore workers can pursue compensation under the Longshore and Harbor Workers’ Compensation Act. In contrast to the Jones Act, this act does not require plaintiffs to prove their employers’ responsibility for the injury through negligence or otherwise. 

Instead, plaintiffs receive compensation limited to a specific set of expenses – not including pain and suffering or loss of consortium. Eligible payments include disability costs and other medical expenses.
