The Jones Act

The Jones Act, also called the Merchant Marine Act of 1920, was created to give seamen the right to sue their employers for compensation if they become injured at work. To qualify, some negligence must have played a part in your accident.

The Longshore and Harbor Workers’ Compensation Act

The Longshore and Harbor Workers’ Compensation Act (LHWCA) is a law that was created to give offshore workers who aren’t considered seamen (and thus, do not qualify for the Jones Act) a chance at pursuing compensation in the case of offshore accidents resulting in injury.

This can apply to any employee who works on the water or in a water-adjacent area, including harbor workers, dock workers, shipping terminal employees, tugboat operators, or workers who load and offload cargo.

Statute of Limitations for the Jones Act and LHWCA

It’s important to note the specific statute of limitations for each of these laws. The Jones Act and the LHWCA each have their own deadlines you will need to follow when filing. Under the Jones Act, you have up to three years to file a lawsuit against your employer. However, the Jones Act follows general maritime law when it comes to reporting the incident, which means you have just seven days to do so.

Under the LHWCA, you have just two years to file for compensation, but you also have up to 30 days to report the accident to your employer.
