How a Lafayette Uber Accident Attorney Can Help You Build a Strong Uber Accident Case

If you decide to work with a Lafayette personal injury lawyer from our firm, we offer to do the following to help grow your case:

1

Identify the Liable Party

Depending on who is involved in the accident, there may be one or more liable parties in your case. For example, Uber may have liability based on the driver’s app status during the crash.

In other cases, the Uber driver, a maintenance company, or a vehicle manufacturer can be liable for damages. Sometimes, a third party may be responsible for causing or contributing to the crash. You can speak with a Lafayette personal injury lawyer to help you pursue compensation.

2

Gather Evidence for Your Case

After an accident, the injured passenger should document as many details as possible while at the scene. This could include the following:

  • Photographs
  • Contact information for all involved drivers
  • Witness statements
  • Video footage of the crash
  • The official accident report

We can help you retrieve the evidence. We can often request information on your behalf if you have not already recovered it.

3

Calculate Your Uber Accident Damages

You could collect several types of damages after an Uber accident in Lafayette. Our attorneys will identify and list all of them after reviewing your case.

While some damages, such as medical expenses, already have an established value, others, such as pain and suffering, need a value assigned to them. We know what it takes to calculate all the losses a client has experienced, and we won’t allow any damages to go unaccounted for.

4

Make Sure You File a Lawsuit on Time

Louisiana law sets the deadline for taking legal action against a liable party for auto accident injuries. Specifically, you have two years to file a personal injury or wrongful death lawsuit from the day the collision or death occurred.

Allowing this deadline to pass means losing your right to take the case to court, which is why our lawyers watch this deadline closely.

5

Represent You in Communications, Negotiations, and Court

One of our Uber accident attorneys in Lafayette, LA, will serve as your legal representative, meaning they can:

  • Handle communications with insurance companies, attorneys, and other involved parties.
  • Negotiate a potential settlement on your behalf.
  • Present your case in court to a judge and jury.

Our team will provide guidance and advice on your legal options throughout the litigation process. However, you remain in control of what actions you want to take in your case.

6

Provide Guidance and Support to Help You Make Decisions

You always have the final say in your case, including whether to accept a settlement offer or go to court.

Our lawyers will provide insight into Louisiana law and cases similar to yours that we’ve handled. That way, you know what to expect and can make informed decisions about your case.

Uber Drivers Have a Greater Duty of Care for Passengers

First, common carriers like rideshare drivers have a heightened duty of care to their passengers.

While all drivers have to follow the rules of the road and avoid injuring others, those who provide transportation as a service are held to a higher standard.

Liability Coverage Varies in Uber Accidents

Identifying the appropriate insurance company can be difficult after an Uber accident. Drivers and their parent rideshare companies both have insurance coverage, and it can be difficult to determine who is responsible for paying damages. This is why so many injured victims seek help from the Lafayette Uber accident lawyers at our law firm. Our team can review your case and identify who may be liable for your bodily injuries and other damages.

Who Is Responsible for Paying an Uber Accident Claim?

If the Uber driver was negligent, the driver’s liability insurance would be responsible for covering damages. However, Uber might also be liable for damages in some circumstances. Identifying the responsible parties requires a detailed analysis of the facts of an accident. By law, the liable party in an Uber collision can depend on whether the driver was actively engaged in a ride. For example, the following scenarios have different liable parties:

  • The Uber driver was not logged into the app: If the driver was not actively logged into the Uber app when the collision occurred, Uber would not be liable for their actions. Instead, the driver’s own auto insurance company would have to cover damages.
  • The Uber driver was on their way to pick up a passenger: If the driver was logged into the app and en route to pick up a passenger when the crash occurred, Uber might cover damages if the driver’s liability insurance is insufficient.
  • The Uber driver was actively transporting a passenger: If the driver was giving a passenger a ride at the time of the accident, Uber would be liable for damages. This may apply even if a third party caused the collision and not the Uber driver.

Per RS § 45:201.6, Uber and other ridesharing companies like Lyft must carry liability coverage in case of an accident. Our legal team can review the incident and identify who the liable party might be in your case. The first step to recovering compensation after an Uber accident is to start a claim with the responsible insurance company.

Damages You May Be Able to Recover in an Uber Accident Case

If you suffered injuries in an Uber accident, we could help you recover compensation for various damages, such as:

  • Medical bills.
  • Pain and suffering.
  • Current and future loss of income, including benefits if applicable.
  • Property damage, if applicable (e.g., vehicle damage if you were in another car that collided with an Uber vehicle).
  • Permanent disability, including loss of a bodily function (e.g., vision or hearing).
  • Physical disfigurement, such as scarring.
  • Loss of enjoyment of life.
  • Emotional anguish.

Wrongful Death Damages

If you lost a loved one in an Uber accident, you may be able to pursue additional losses related to their death. For example, you may be able to recover compensation for the following:

  • Funeral costs
  • Burial or cremation expenses
  • Pain and suffering felt by the decedent and surviving family members
  • Loss of income from the deceased person
  • Loss of parental guidance
  • Loss of companionship
  • Loss of consortium

Losing a loved one can be difficult to cope with, and trying to navigate the legal system alone can add to your stress. Allow our team to prepare your wrongful death case on your behalf while you grieve with your family in private.

Frequently Asked Questions

How Much Insurance Must Uber Carry During Each Phase of a Trip?

The amount changes depending on what the driver was doing, and the numbers are more specific than "Uber's policy kicks in." Under La. R.S. 45:201.6, during the pre-trip acceptance period, meaning the driver is logged into the app and available but has not yet accepted a ride, coverage must be at least $50,000 per person and $100,000 per incident for death and bodily injury, plus $25,000 for property damage. Once a ride is accepted and the driver is en route to the passenger or actively transporting one, that minimum jumps to $1 million in combined coverage. Knowing which period applies to your crash is often the single biggest factor in how much money is actually available to compensate you.

Does My Own Auto Policy's Uninsured Motorist Coverage Apply If I'm Hurt as an Uber Passenger?

It can. Louisiana requires the insurance to be carried under La. R.S. 45:201.6 to include uninsured and underinsured motorist coverage to the extent required by La. R.S. 22:1295. That means if the at-fault driver in your crash, whether that is your Uber driver or someone who hit the Uber vehicle, does not carry enough insurance to cover your damages, the rideshare policy's own UM coverage may fill the gap. Your personal auto policy's UM coverage may also apply, depending on how it is written. Sorting out which policies stack and which do not is exactly the kind of coverage analysis our team handles for clients.

Can I Sue Uber Directly, or Only the Driver?

It depends on the theory of liability. Uber classifies its drivers as independent contractors rather than employees, a classification it has historically used to argue that it is not directly responsible for a driver's on-road negligence. That said, the insurance requirements built into Louisiana law effectively make Uber's own policy the source of payment once a ride is accepted, so in practical terms, you are often pursuing Uber's insurer even when you are not suing Uber the corporation for its own negligence. There are also situations, such as inadequate driver screening or a defect in how the app matched a ride, where a direct claim against Uber itself may be worth exploring.

I Was a Pedestrian, Cyclist, or Occupant of Another Vehicle Hit by an Uber Driver. Does the Same Framework Apply?

Yes. You do not have to be riding inside the Uber to have a claim. The insurance tiers described above exist to cover anyone injured by the rideshare vehicle, not just the passenger inside it. If you were walking, biking, or driving another car when an Uber driver hit you, the same question of whether the driver was logged off, waiting for a match, or actively on a trip still determines which policy and which coverage limit applies to your claim.

What if Another Driver, Not My Uber Driver, Caused the Crash?

Uber's insurance coverage does not disappear just because a different driver caused the wreck. If you were riding in an Uber that was actively transporting you, and a third-party driver ran a red light and hit you, Uber's $1 million policy may still apply to help cover your damages, on top of any claim against the at-fault driver's own insurance. This is one of the more counterintuitive parts of rideshare accident law, and it is a major reason these cases often involve two or three insurance companies at once.

What Happens if My Uber Driver or the At-Fault Driver Flees the Scene?

A hit-and-run does not mean you are out of options. If the fleeing driver cannot be identified, uninsured motorist coverage, whether through Uber's policy, your own auto policy, or both, typically treats an unidentified driver the same way it treats a known driver with no insurance. Reporting the accident immediately and gathering whatever evidence you can, including dashcam footage, witness accounts, and the police report, gives your attorney the strongest foundation for that UM claim.

What if the Rideshare App's Records Conflict With What Actually Happened?

App data showing a driver's login status, trip acceptance time, and GPS location is often the most important piece of evidence in a rideshare case, as it determines which insurance tier applies. But that data lives with Uber, not with you, and it does not always match the driver's own account of events. Requesting and preserving this data quickly after a crash matters because it can be the difference between a $25,000 claim and a $1 million one. This is exactly the kind of evidence our team moves fast to secure before it can be disputed or lost.
