What Is Product Liability?

Product liability cases occur when a dangerous or defective product causes injury. Manufacturers have a responsibility to consumers to design, make, and distribute safe products. When they fail to do so, the users of their items could get hurt. Under Louisiana law, the company may be legally responsible for any injuries, expenses, and losses that occur.

Our produce liability attorneys represent the victims in these accidents, including adults, parents of injured children, and families of those who passed away from their injuries. We know how to build these cases and work based on contingency fees. We never ask our clients to pay us upfront to manage their cases.

Common Types of Dangerous and Defective Products

Almost any product can be defective. However, most will not cause significant injuries. This is why most product liability cases tend to focus on a handful of product types.

This includes:

  • Auto parts: When there is a problem with tires or an auto part, it can cause a crash and serious injuries.
  • Medications: Medications can sometimes cause unintended and unlisted complications because of issues with their design, manufacture, or missing warnings
  • Medical devices: Medical devices can cause more harm than good under some circumstances; there have been many mass torts based on defective devices
  • Children’s products: Toys and other products made for children are often harmful to babies, especially if they have small parts or incomplete instructions
  • Tools: Power tools and household items top the list of dangerous tools, often because of manufacturing defects or poor instructions

Some people believe you only have a product liability claim if there is a recall on the product. This is a myth. Almost any product can support this type of lawsuit so long as you can show your injuries occurred as a result of using the product as intended or in a way the manufacturer could have predicted.

Holding a Company Liable for Its Defective Products

Our attorneys for product liability know how to investigate, develop, and file a products liability case in Lafayette. In general, there are three ways a company can be liable for a dangerous product. This includes:

  • Defective Design: If a product is not designed well or there are inherent issues, the designer may be legally responsible for any injuries.
  • Defective Manufacture: The manufacturer is liable if something goes wrong in the manufacturing process that makes a product dangerous.
  • Inadequate Warning: A company may be legally accountable for injuries or illness when they fail to provide adequate warnings or instructions for their products.

Our lawyers may be able to uncover the cause of your injuries and build a case showing how the company is responsible. We will gather evidence and develop a claim for compensation based on your injuries. We may be able to help you recover compensation for:

  • Medical bills, current, and future
  • Lost wages
  • Reduced earning capacity
  • Property damages
  • Pain and suffering
  • Other non-economic losses
  • Wrongful death losses

You can trust us with your case. We have helped thousands of clients with the claims process. We may be able to help you get justice and recover money damages based on your injuries. We will answer your questions and explain more during a free consultation.

Examples of Product Liability Cases

Widespread product liability cases often support mass torts, such as class action lawsuits or multidistrict litigation. These often get a lot of media coverage. Two large product liability cases you may have heard about include:

Takata Airbag Recall

The largest automotive recall in history centers on the defective Takata airbags found in millions of vehicles manufactured by Honda, BMW, Chrysler, Daimler Trucks, Ford, General Motors, Mazda, Mitsubishi, Nissan, Subaru, and Toyota. The defect results in shrapnel-like metal shards and airbag components propelled throughout the vehicle interior. When airbags are deployed, it frequently results in lacerations and blunt-force trauma that can cause injury or death. We are also handling Honda airbag cases with more minor injuries that normally would not qualify for claims under our usual review process, even an injury that does not appear to be permanent or life-threatening.

Defective Tires

Tire failure can result in a serious car crash and even a vehicle rollover accident, causing severe injury or death to vehicle occupants.

Air, heat, and sunlight can cause the rubber in tires to break down. When a tire is defective, potentially serious problems like tread breakdown and blowouts can occur long before the tire would be expected to wear out.

If the tire failure results from design or manufacturing defects, and the manufacturer is aware of the problem, they have an obligation to alert consumers to the potential danger.

I am able to witness Karely Cornwell handle calls from people who are in need of Laborde Earles services. She is always polite and professional. I think it’s safe to assume that the majority of people who call in are stressed and to have someone who is calm and kind taking the call is a great representation of the company.
