That failure can become powerful evidence of negligence.

My Employer Carries Workers' Comp. Can I Still Sue Someone Else for My Injury?

Yes, and this is one of the most important things injured construction workers miss. Louisiana law makes workers' compensation your exclusive remedy against your own employer, under La. R.S. 23:1032, which means you generally cannot sue your employer directly for a workplace injury. But construction sites are crowded with other players: general contractors, subcontractors, equipment owners, and material suppliers who are not your employer. If one of them caused or contributed to your accident, you may be able to file a separate personal injury lawsuit against them on top of your workers' comp claim and recover damages workers' comp does not cover, like pain and suffering.

What Is Louisiana's "Statutory Employer" Doctrine, and How Could It Affect My Claim?

On multi-contractor job sites, Louisiana law can treat a general contractor as your "statutory employer" even if a subcontractor is the one who actually signs your paycheck. Under La. R.S. 23:1061, a principal contractor who brings in a subcontractor to do part of the job can be granted the same exclusive remedy protection as a direct employer, meaning that the contractor may be shielded from a lawsuit, too. Whether this doctrine applies often depends on the specific contract language between the companies at issue.

What if Defective Equipment or a Faulty Tool Caused My Injury?

If a crane, nail gun, scaffold component, or piece of heavy machinery failed because of how it was designed, built, or labeled, you may have a claim against the manufacturer under the Louisiana Products Liability Act. This is a separate legal theory from a standard negligence claim against a contractor or property owner, and it does not require proving anyone was careless, only that the product itself was unreasonably dangerous. Equipment failures on construction sites often involve multiple potentially liable parties: the manufacturer, the company that rented or maintained the equipment, and the contractor who put it into use.

What Is Premises Liability, and How Is It Different From a Standard Negligence Claim?

Premises liability is a specific legal theory that applies when a property owner or the party in control of the site knew, or reasonably should have known, about a dangerous condition and failed to fix it. Under Louisiana Civil Code Article 2317.1, the owner or custodian of a thing, which can include a job site, is answerable for damage caused by a defect only if they knew or should have known about it and failed to exercise reasonable care. This is narrower than a general negligence claim, which can cover a much wider range of careless conduct. On a construction site, both theories often apply simultaneously against different parties.

Can an OSHA Safety Citation Against a Contractor Help My Case?

It can be a significant piece of evidence. If OSHA investigated your accident and cited a contractor or subcontractor for a safety violation, that citation shows a government safety agency found the company fell short of a legally required standard. While an OSHA citation alone does not win a personal injury case, it can support your argument that the responsible party breached its duty of care, especially when paired with witness statements, accident reports, and physical evidence from the scene.

I Was Hired as an "Independent Contractor" on the Job Site. Do I Have Workers' Comp Coverage?

It depends on what you were actually doing, not just what your contract calls you. Under La. R.S. 23:1021, someone labeled an independent contractor is still covered by Louisiana workers' compensation if a substantial part of their work time is spent doing manual labor. Construction companies sometimes label workers as independent contractors to avoid providing coverage, even when the day-to-day work looks just like an employee's. If you were hurt while doing hands-on labor on a job site, do not assume you are automatically shut out of workers' comp or a lawsuit. Get your classification checked before you accept anyone's word for it.
