How Long After a Demand Letter does a Settlement Take?

There is no set amount of time between when you send a demand letter to the insurance company and when your case settles. Every case is unique and will vary in how long it takes to resolve.

Our Lawyers will Attempt to Settle Your Case as Quickly as Possible

Our attorneys understand that the sooner you receive compensation for your injuries, the sooner you can start to get your life back on track. We want to help you settle your case as quickly as we can. How long it takes to reach a settlement will depend on several factors, including:

  • The complexities of your accident
  • The severity of your injuries
  • The value of your damages, and
  • How long it takes to negotiate an agreement that satisfies all parties

Your lawyer will also need time to collect evidence and build a case proving that another person’s negligence caused your injuries. The entire process can take weeks, months, or even years if your case goes to trial.

Our team will make every effort to settle your case without going to court. However, if we cannot secure the awards you need another way, we can assist you with a lawsuit. Going to trial will increase the time it takes to get compensation, but it may be worth it. Our attorneys can help you learn more about your legal options.

If You Wish to Take Legal Action, You are Bound by the Statute of Limitations

There is no legal deadline for settling a case through insurance. But if your case goes to court, you must file your lawsuit within the time limit that Louisiana allows. According to CC 3493.1, you have two years to take action for personal injury. CC §2315.2 allows two years for eligible parties to file a wrongful death case.

In general, you cannot pursue your lawsuit if your window of time runs out. However, there may be exceptions that could extend or reduce the statute. Your lawyer can tell you more and answer any questions you have.

What Can You Win in a Personal Injury Settlement?

You can seek compensation for your accident-related out-of-pocket expenses and pain and suffering. If your loved one died because of a personal injury, you might be eligible to seek these awards on their behalf in a wrongful death action.

Economic Damages

These awards include your past and future medical treatment, rehabilitation services, the cost of medical devices, and travel expenses related to your health care. Economic damages also compensate victims for their lost wages, loss of future earning capacity, and the value of their lost household services. You may also seek awards for property damages.

Non-Economic Damages

These damages offer victims financial compensation for the ways in which their accident has reduced their quality of life. This includes awards for physical pain, emotional suffering, and mental anguish.

The reassurance from Digger and his staff gave me that renewed hope that it’s going to be okay down the road.
