While insurance claims are generally more common and often successful in recovering the compensation our client deserves based on the case facts, we sometimes need to sue and prepare the case for a trial. This could occur concurrently with the insurance claim, meaning we continue to negotiate with the carrier while we navigate the stages of the lawsuit process.
Louisiana law generally only gives our team two years from the date the injuries occurred to begin a lawsuit on our client’s behalf. Per CC 3493.1, if we do not file the paperwork to begin a Lafayette civil suit before the first anniversary of our client’s injuries, they could lose the right to do so in the future. Some exceptions exist, but these could reduce how long you can wait to sue.
