There is no legal deadline for settling a case through insurance. But if your case goes to court, you must file your lawsuit within the time limit that Louisiana allows. According to CC §3492, you have two years to take action for personal injury. CC §2315.2 allows two years for eligible parties to file a wrongful death case.
