How Do I Pay Medical Bills After a Truck Accident?

How do I pay medical bills after a truck accident? Medical bills after a truck accident are often paid by settlement or judgment, depending on the circumstances of your case.

A Louisiana truck accident lawyer can help you identify whether to file a claim against the truck driver, trucking company or a third party to recover your losses.

What to Do After a Truck Accident

Following a truck accident, it is vitally important to seek immediate medical attention. Due to the size of commercial trucks, these types of injuries are often catastrophic in nature and require immediate care. Even if you do not feel like you are injured, it is essential to get checked for injuries that may be hidden by the adrenaline surge you could experience after being in an accident.

Even if someone else was responsible for your accident, you may need to use your own insurance and health coverage to pay initially. Some healthcare providers may require immediate payment, which is where your own insurance will be helpful. Just use your insurance, keeping detailed records of all your medical bills and related documentation, involving any invoices, receipts, and documents regarding treatment plans.

Other healthcare providers may allow you to wait for payment from the at-fault party’s insurance company. Speaking with a Louisiana truck accident lawyer can help you determine the best step forward here. Be sure to call and discuss your current financial situation and the ideal choice for paying medical bills after a truck accident.

How Does Louisiana Insurance Work in a Truck Accident Claim

Truck accidents can leave victims with lifelong physical injuries, emotional distress, and substantial financial burdens for years to come. The legal framework for truck accidents is complex, and determining who will cover these medical expenses can be a significant challenge, especially since multiple parties may share responsibility for these types of accidents.

Working with a truck accident lawyer can help you understand the right way to pay medical bills after a truck accident and pursue compensation from any liable parties.

Negligence Laws

Louisiana adheres to a fault-based system, meaning that the party responsible for causing the accident is generally liable for the resulting damages, including medical expenses. Under the Louisiana Department of Auto Insurance, drivers of any vehicle must have liability coverage to pay for personal injuries or property damage that they cause. Each vehicle must have $15,000 for bodily injury of one person, $30,000 for bodily injury of more than one person, and $25,000 for property damage.

No matter who caused your accident, you will need to notify your insurance provider of your accident. You can file with your insurance company even if you plan to pursue the at-fault driver for compensation at a later time. Your focus needs to be on seeking immediate medical attention after a truck accident, no matter who will be left with the bill.

Uninsured Motorist Coverage

Under Louisiana State Legislature RS 22§1295, insurance companies must offer drivers uninsured motorist (UM) coverage. For policyholders with this type of coverage, this can be used to cover medical expenses and other damages after an accident with an uninsured driver. It is unlikely that a commercial truck driver would have insurance, but this coverage can also be used in cases where an at-fault party is underinsured, meaning their policy does not fully cover your expenses.

Recovering Compensation for Your Medical Bills After a Truck Accident Depends on Liability

The question of who pays the medical bills after a truck accident hinges on several key factors, primarily liability. If the truck driver’s negligence caused the accident, their insurance company is typically responsible for covering the medical expenses of those injured. However, liability can also extend beyond the driver in truck accidents.

The trucking company, those responsible for loading the cargo, and even the truck manufacturer may all bear some degree of responsibility, depending on what caused your accident. Accurately identifying all liable parties is crucial to ensuring victims receive full compensation for their medical expenses and other damages. Your trucking accident lawyer can help you navigate this process and craft a solid claim against any liable parties.

Whether you are pursuing a claim or lawsuit, the burden will be on you to provide proof of negligence. Gathering documents and photos, speaking with eyewitnesses, and contracting accident reconstructionists who can help provide vital evidence to build a strong case against the at-fault party. Your accident attorney can also help you gather truck-specific proof, such as data from Event Data Recorders (EDR), like speed, GPS location, and maintenance records.

The reassurance from Digger and his staff gave me that renewed hope that it’s going to be okay down the road.

Louisiana Statute of Limitations for Truck Accident Victims

Previously, under Louisiana law, you only had one year to recover compensation for personal injury claims. As of July 1, 2024, under Civil Code Article 3493.11, this legal deadline, called the statute of limitations, has been expanded to two years. This time limit begins on the date that your injury was sustained and allows you to pursue your claim or personal injury lawsuit up until two years from that date.

This is still a relatively short window of time to file a claim, so it is vital to get started as soon as possible to ensure you are not blocked from obtaining your fair settlement amount. Certain exceptions apply to this general time limit. Be sure to consult with an accident lawyer to determine if you can still file.
